Terms of Service (My Flip-Screen)

Welcome to Flip-Screen (“App”). These Terms of Service ("Terms") govern your use of our mobile application. By downloading or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Use of the App

Incase Flip-Screen allows users to sync custom images to compatible My Flip-Screen case.
You may use the App only for lawful purposes and in accordance with these Terms.

To use Flip-Screen, you must:

Be at least 13 years old (or the minimum legal age in your country)
Use the app in accordance with all applicable laws and regulations
Not misuse, reverse-engineer, or attempt to exploit the app in unauthorized ways

2. Accounts

Creating an account is optional. If you choose to create one:

You must provide a valid email and password
You are responsible for maintaining the confidentiality of your login credentials
You agree to notify us immediately of any unauthorized use

You may also use the App as a guest via the “Skip for Now” option.

3. User Content

You may upload or sync your own images through the App.

By using this feature, you represent that:

You have the right to use and share the content
The content does not violate any laws, infringe on rights, or contain harmful or offensive material

We do not store your personal content. It is saved locally on your device only.

4. Intellectual Property

All trademarks, logos, and content created by Incase Flip-Screen are the property of Onward Brands LLC/Incase.

You may not:

Copy, modify, distribute, or republish any portion of the App without permission
Use the App’s content for commercial purposes without our prior written consent

5. App Updates and Changes

We may update or modify the App from time to time. These updates may:

Fix bugs or improve performance
Add or remove features

Continued use of the App after an update constitutes acceptance of the revised version.

6. Termination

We reserve the right to suspend or terminate access to the App if:

You violate these Terms
We discontinue the App
There is a security or operational concern

You may also stop using the App and delete it from your device at any time.

Account Termination by User:
You may terminate your account and delete your data at any time using the in-app “Delete Account” feature. Once deletion is confirmed, we will permanently erase your account information. Please note that this action cannot be reversed.

7. Disclaimers and Limitations of Liability

Flip-Screen is provided “as is” without warranties of any kind.

We do not guarantee:

That the App will always be available or error-free
That synced images will always appear as expected on your device or display case

To the fullest extent permitted by law, we are not liable for:

Any indirect or consequential losses
Loss of data or inability to use the App
Issues caused by misuse, third-party hardware, or software conflicts

8. Governing Law

These Terms are governed by the laws of the state of New York, without regard to conflict of law principles.

9. Dispute Resolution & Arbitration

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Flip-Screen app, you and Onward Brands agree to resolve the matter through binding arbitration, rather than in court.

a. Arbitration Process

- The arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration provider. The arbitration will be conducted in New York, unless otherwise agreed.

b. Waiver of Class Actions

- You and Onward Brands agree that any disputes will be resolved individually, and not as part of a class, consolidated, or representative action. You waive any right to a jury trial or to participate in a class action.

c. Exceptions to Arbitration

Both parties retain the right to:

- Bring individual claims in small claims court
- Seek injunctive or equitable relief in court for unauthorized use of intellectual property

d. Governing Law

- This arbitration agreement shall be governed by and interpreted in accordance with the laws of the state of New York, without regard to its conflict of law principles.

10. Changes to These Terms

We may revise these Terms from time to time. Updated versions will be posted in the App or on our website. Your continued use of the App after any changes constitutes your agreement to the new Terms.
